These negotiations are based on Article 49 of the Treaty on EU and their objective is laid down in the European Council conclusions of December 2004. These negotiations are an open-ended process, the outcome of which cannot be guaranteed beforehand. While taking account of all Copenhagen criteria, if Turkey is not in a position to assume in full all the obligations of membership or if the Union is not in a position to absorb Turkey it must be ensured that Turkey is fully anchored in the European structures through the strongest possible alternative bond. This process will take into account all Copenhagen criteria, including the absorption capacity of the Union which is the condition to be fulfilled by the EU prior to Turkish accession.
